Limitation of liability / Important legal notice

1. Nature of the Service

FinLeakage provides software tools that identify potential anomalies, exceptions and risk indicators from uploaded data. The Service does not guarantee the accuracy, completeness or suitability of any output for a particular purpose, and outputs must be independently reviewed by a suitably qualified person before being relied upon.

2. No professional advice

The Service does not provide legal, audit, accounting, tax, forensic, banking, compliance or investment advice, and no output should be treated as a substitute for professional judgment or professional services.

3. Assumption of risk

You acknowledge that:

• (a) analytical tools may produce false positives, false negatives, incomplete results, prioritisation errors, or outputs affected by source-data quality, mappings, thresholds and assumptions;
• (b) operational interruptions, latency, third-party service failures and data-quality issues may affect the Service; and
• (c) you remain responsible for reviewing outputs and deciding what action, if any, should be taken.

4. Excluded losses

To the maximum extent permitted by law, FinLeakage will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, savings, business opportunity, goodwill or data, arising out of or in connection with the Service.

5. Liability cap

To the maximum extent permitted by law, FinLeakage's total aggregate liability arising from or relating to the Service, whether in contract, delict, statute or otherwise, will not exceed the total fees paid by you for the Service during the 12 months immediately preceding the event giving rise to the claim.

6. Non-excludable matters

Nothing in this notice or in the Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, wilful misconduct, or any rights that you have under applicable mandatory law.

7. Customer indemnity

You indemnify FinLeakage and its personnel against third-party claims arising from your unlawful use of the Service, your breach of the Terms, your lack of authority to upload or instruct the processing of Customer Data, or your infringement of third-party rights, except to the extent the claim arises from FinLeakage's own fraud, wilful misconduct, or unlawful conduct that cannot be excluded.

8. Customer acknowledgement

By ticking the acceptance box, clicking accept, subscribing, paying for, or using the Service, you acknowledge that you were given adequate notice of this section, had an opportunity to review it, and agree to it.
